TOPIC: Products placed on the market or taken into service.

BACKGROUND: The CE marking directive 93/68/EEC amended the EMC Directive 89/336/EEC. Article 3 of the directive was amended to indicate that products placed on the market or taken into service must meet the conformity assessment requirements set out in Article 10. This change is not reflected in the UK's amended legislation.

PROBLEM: Can the installers/end users base compliance of apparatus taken into service (but not supplied) on the UK's regulations or should the Directive apply?

GUIDELINES: Installers/end users located in the UK are bound, in the first instance, by UK national law (SI 2372: 1992 as amended by SI 3030: 1994)

The European Commission is responsible for ensuring that each member state interprets the directive correctly.
